世界知识产权组织于1996年通过了网络环境下的两个版权保护新规则,即《世界知识产权组织版权条约》(WCT)和《世界知识产权组织表演和录音制品条约》(WPPT),世界各国逐渐将技术保护措施纳入各自著作权法保护的范围。我国也在2001年修订了《著作权法》,增订了技术保护措施的内容。各国立法对技术保护措施的界定,包括对其范围、有效性和目的合法性的界定。技术保护措施是著作权的一项保护性权能,而不是财产性权利或邻接权。著作权法对接触控制措施的保护既会使合理使用原则没有适用余地,也会使首次销售原则落空,对各国反规避条款规定的侵权行为与法律救济的比较分析,显示出直接规避行为和帮助性行为各自的危害,只有有效遏制帮助性行为才能真正实现技术保护措施的立法目的。我国《著作权法》中的反规避条款尽管存在种种不足,但将接触控制措施摒弃于保护范围之外,是其最大的亮点。完善我国技术保护措施立法的构想,就是既要尽量避免承担不必要的国际义务,维护我国的经济文化利益,又要切实保护著作权人的权益,提高保护的效率和力度。

A comparative analysis of the infringement and legal remedies stipulated in anti-circumvention provisions in various countries shows that direct circumvention and helpability Their own harm, only to effectively curb help to achieve the true purpose of technical protection measures for legislative purposes. Anti-circumvention provisions in the Copyright Law of our country, despite all the deficiencies, are the biggest bright spot in putting the control measures out of their scope of protection. The idea of perfecting the legislation on technical protection measures in our country means that we should try our best to avoid unnecessary international obligations and safeguard the economic and cultural interests of our country. We must also effectively protect the rights and interests of copyright holders and enhance the efficiency and intensity of protection.
