从历史发展上看,威斯特伐利亚和会开辟了国家之间签订契约的可能,国际联盟和联合国则进行了全球性国际社会契约的两度试验。国际社会契约在各方面、各层次的实践凝聚了国家的共识,积累了国际法治的经验,但也存在大国政治、不成体系、价值模糊的问题。作为一个制度路径,国际社会契约应当坚定地建立在人本主义的基础之上,通过政府的互信、合作来实现人的自由、全面、可持续发展;通过政府共同转让权能的国际机制来充分地保障个人权利、展现人类价值。为保障国际社会契约目标的实现,局部契约应逐渐深化、相互协调,并调整全局契约,实现契约机制的协调,并最终形成全球契约。
