一、为了适应建立现代企业制度的需要,规范企业破产行为,根据《中华人民共和国企业破产法(试行)》、《国务院关于在若干城市试行国有企业破产有关问题的通知》以及国家其他有关法律、法规,制定本规定。二、国有企业(以下简称“企业,’)试行破产,应坚持依法实施、优化资源配置和妥善安置职工的原则,有利于建立和完善企业优胜劣汰机制,保护债权人、债务人合法权益。三、各级主管财政机关会同国有资产管理部门参与企业破产的全过程,在企业破产中履行下列职责:(一)参与制订企业破产预案;(二)参与破产清算组,负责办理与破产财产
