政府的市场规制在我国和全球势不可挡。与规制部门相比,法院在知识结构的改进和信息更新方面不具有天然的优势;我国政府规制独特的发展历程和目前的某些制度安排使法院这方面明显处于劣势。波斯纳建议中国和发展中国家的法院为了获得司法独立和建立司法权威采取“超脱”策略,减少对复杂社会问题的介入。但这样会进一步减少中国法官在工作中获取信息和更新知识的机会,拉大法院和规制部门在这方面的差距。规制部门与法院在资源、管理权和人才等方面存在激烈的竞争,竞争力的下降将无助于法院争取司法独立和树立司法权威。为使法院保持足够的机构竞争力,未来中国司法改革应当以增加信息流入和提高信息质量为方向。
The government’s market regulation is overwhelming in our country and in the world. Compared with the regulation department, the court does not have the natural advantage in improving the knowledge structure and updating the information. The unique development course of our government regulation and some current institutional arrangements make the court obviously have a disadvantage. Posner suggested that courts in China and other developing countries should adopt a “detached” strategy in order to obtain judicial independence and establish judicial authority, so as to reduce the involvement in complex social issues. However, this will further reduce the chances for Chinese judges to obtain information and update knowledge in their work and widen the gap between the courts and the regulatory authorities in this regard. Regulatory agencies and courts have fierce competition in terms of resources, management power and personnel, and the decline in competitiveness will not help the court to strive for judicial independence and establish judicial authority. In order to make the court maintain sufficient institutional competitiveness, China’s judicial reform in the future should take the direction of increasing information inflow and improving information quality.
