行政区划调整对于土地使用权出让合同能否顺利履行之影响体现在其是否可以适用情势变更原则。《最高人民法院关于适用<中华人民共和国合同法>若干问题的解释(二)》仅对“情势变更”作出原则性规定而缺乏指导意义。本文将通过案例提出问题,即情势变更能否事先约定及情势变更原则在纠纷产生后的适用和救济,来阐述情势变更原则在土地出让合同中的应用。
