判断保险人是否已尽说明义务是保险纠纷司法实务中的焦点问题。我国保险法及最高人民法院的司法解释均未对保险人说明义务的范围、方式及其程度标准作出明确的规定,导致司法实践中对保险人是否已尽该义务的认定出现相似案件相反判决的尴尬。为了破解上述司法困境,应当在对保险人说明义务进行严格限定的同时,避免片面地强调投保方利益的倾斜性司法保护。按照利益衡平的理念,在现行立法框架下对该义务履行的对象范围和程度标准进行明确和完善。
Determining whether the insurer has exhausted the obligation is the focus issue in the judicial practice of insurance dispute. China’s Insurance Law and the judicial interpretation of the Supreme People’s Court do not make any clear stipulations on the scope, methods and standards of the insurer’s obligation of explanation, which leads to the embarrassment of judging whether the insurer has fulfilled the obligation in the judicial practice or not. . In order to solve the above judicial difficulties, we should strictly limit the insurer’s explanatory obligations while avoiding one-sidedly emphasizing the oblique judicial protection of the interests of the insuring parties. In accordance with the concept of balance of interests, under the current legislative framework to fulfill the obligations of the object range and level of standards clear and perfect.
