刑事申诉制度是刑事诉讼中的重要制度,刑事诉讼法对其作出了明确规定。尽管如此,我国刑事申诉制度仍有许多不尽如人意之处,在理论界引起了极大的争议,在实践中存在诸多问题。如何对其进行完善,是当前司法改革中必须关注的一个现实问题。 The system of criminal appeals is an important system in criminal proceedings, and the Criminal Procedure Law clearly stipulates them. In spite of this, there are still many unsatisfactory places in China’s criminal appeal system, which have caused great controversy in the theoretical circles. There are many problems in practice. How to perfect it is a realistic problem that must be paid attention to in the present judicial reform.
