作为农村经济互助的重要形式,捐会在当代中国农村社会仍然广泛存在。本文以浙江省慈溪市附海镇庙西村蒋家丁自然村的捐会为考察对象,探讨了捐会的成立、内容、形式、履行、变更规范与关系的内在联系,分析了当代中国债权习惯法发挥功能的信任基础和社会背景、文化因素。 As an important form of rural economic mutual aid, donations are still widespread in rural China in contemporary China. This essay takes the donation meeting of Jiang Jiding Village in Miaoxi Village, Fuhai Town, Cixi City, Zhejiang Province as the object of study, and discusses the internal connection between the establishment, content, form, fulfillment and change of norms and relations, analyzes the contemporary customary law of creditor’s rights in China Functional basis of trust and social background, cultural factors.
