证券监管理念是监管者开展监管工作的指南。证券行政监管法治化理念是依法治市的思想保证。本文在证券行政监管法治化创新理念的研究中,分析如何以法治思维和法治手段突出证券行政监管在证券监管体系中的优势,具体改革建议为:市场化的事后监管理念的培养,建立分层化的证券监管体系,严格证券行政监管执法程序,引入证券行政监管的司法审查制度。期望通过证券行政监管法治化创新理念的引领,实现依法治市的预期目标。
The securities regulatory concept is the guide for regulators to carry out supervision. The concept of legalization of securities administrative supervision is the ideological guarantee according to law. In this paper, we study how to highlight the advantages of the securities regulatory system in the securities regulatory system by means of the rule of law and the rule of law in the research on the legal concept of the securities administration supervision and innovation. The suggestions for reform are as follows: to cultivate the market- The securities regulatory system, strict securities administrative supervision and law enforcement procedures, the introduction of the securities administrative supervision of the judicial review system.
