仲裁条款作为仲裁协议的一种,是当事人在争议发生之前,在合同中以合同条款的形式达成的将可能发生的争议提交仲裁的一项约定。由于提单特殊的性质和功能,使得提单中的仲裁条款有着明显的特殊性。因而理论界对于提单中仲裁条款的效力问题争论激烈本文从合同法的视角,阐述了在不同当事人之间,班轮提单中的仲裁条款的效力问题。 As an arbitration agreement, an arbitration clause is an agreement reached by the parties to submit a possible dispute to arbitration in the form of a contract clause before the dispute arises. Due to the special nature and function of bill of lading, the arbitration clause in bill of lading has obvious particularity. Therefore, there is a heated debate between theorists in the validity of the arbitration clause in the bill of lading. From the perspective of contract law, this article expounds the validity of the arbitration clause in the liner bill of lading between different parties.
