“今日头条”作为一种新兴媒体的传播方式,其加框链接是否构成信息网络传播权的直接侵权是当下讨论的热点之一。判断加框链接是否直接侵权的有“用户感知标准”和“服务器标准”两种标准,理论和实践中都采用“服务器标准”。本人认为“今日头条”加框链接不属于《信息网络传播权条例》规定信息网络传播权侵权构成中的第三方主体,而属于一种不侵犯作者著作权的新的传播方式。 “Today’s headlines ” as a new way of media dissemination, the framed link constitutes a direct infringement of the right to broadcast information network is one of the hot issues discussed.
