地方政府权力清单制度的推行,是落实党中央“把权力关进制度的笼子”这一要求的具体举措,这一要求充分显示了党中央依法治国的决心和信心。实行权力清单制的初衷是保证行政机关在法律规定的职权范围内行政。目前,无论是在学术界还是在行政管理队伍中,都存在“清单之外无权力”的说法。这是对“法无授权不可为”这一要求的片面理解。这种说法对突出权力清单的权威性有一定作用,然而容易影响地方政府正常地行使权力。只有在充分了解权力清单本质属性的基础上,才能对权力清单的内涵有全面而准确的把握。从编制主体、编制程序、主要内容以及实际效力等方面来看,权力清单应属于规范性文件而不属于规范性法律文件。

This is a one-sided understanding of the requirement that “law can not be lawless.” This view on the authority of the prominent list of powers have a certain effect, but easily affect the normal exercise of local government power. Only on the basis of fully understanding the essential nature of the power list can we have a comprehensive and accurate grasp of the content of the power list. From the preparation of the main body, the preparation of procedures, the main content and the actual effectiveness of the point of view, the list of powers should belong to normative documents and not a normative legal document.
