黑社会性质组织犯罪作为我国集团犯罪的主要代表,自从1997年刑法修订案以具体罪名确立于刑法以来,一直成为人们关注的焦点。目前为止,对黑社会性质组织的认定并没有一个合适的标准,导致在判定黑社会性质组织犯罪与一般组织犯罪时出现争议,影响了共同犯罪研究的发展与司法审判的公正。由此可见,明确黑社会性质组织的性质,严格区分黑社会性质组织犯罪与其他组织犯罪,不仅是我国罪刑法定刑法原则的要求,更是保障共同犯罪领域罪犯人权益的起点和基础。
As the main representative crime of the Chinese group, the crime of criminal syndicate has been the focus of attention since the criminal law amendment was established in criminal law on the basis of specific charges in 1997. So far, there is no suitable standard for the identification of triad. As a result, there is controversy in judging the crime of underworld organization and the crime of general organization, which affects the development of common crime research and the justice of judicial trial. Therefore, to clarify the nature of underworld organizations and strictly distinguish between underworld organizations and other organizations is not only the requirement of the criminal law statutory principle in our country, but also the starting point and basis of protecting the rights and interests of criminals in the field of common crime.
