房屋所有权侵权案例在司法实务中大量发生,当被侵权人返还财产的诉求无法实现时,便涉及请求损害赔偿,其中房屋所有权侵权赔偿原则和计算标准问题直接涉及到被侵权人的财产是否能够得到法律充分有效的保护。房屋所有权侵权赔偿的原则应根据直接财产损失和间接财产损失的分类适用不同的赔偿原则。房屋所有权侵权赔偿的计算标准应当根据损失发生时的市场价格并结合其他因素进行综合考虑。
