虽然劳动争议仲裁和诉讼是劳动争议纠纷解决的一个有机整体,但并没有专门的法律对这两种程序作出统一的规定。由于缺乏统一的规定,两种程序在如何衔接的问题上,难免会产生诸多争议。典型案例分析可见,劳动争议的诉讼管辖地与仲裁管辖地应当保持一致。当事人不服仲裁裁决起诉的,只能向作出仲裁裁决的劳动争议仲裁委员会所在地人民法院提出。在我国,劳动争议诉讼实行仲裁前置,这就决定了劳动争议诉讼与仲裁在管辖上存在密切的牵连
Although labor dispute arbitration and litigation is an organic whole of labor disputes dispute resolution, there is no specific law that provides uniform rules for both procedures. Due to the lack of uniform provisions, many disputes will inevitably arise on the issue of how the two kinds of procedures converge.
