标准化中的合理无歧视原则来源于产业实践,目前还没有清晰的法律地位。从专利法和反垄断法看,都没有直接与合理无歧视原则对应的规则。合理无歧视的法律性质应当界定为一种合同性质的义务,其特征包括自愿性、不可撤回性、对世性和内容的不确定性。合理无歧视原则对于推进标准制定能够发挥积极的作用,但是实践也要求它被赋予更加具体充实的含义。
The principle of reasonable non-discrimination in standardization comes from industrial practice, and at present there is no clear legal status. From the perspective of patent law and antitrust law, there are no rules that directly correspond to the principle of reasonable non-discrimination. The legal nature of reasonable non-discrimination should be defined as an obligation of a contractual nature characterized by its voluntariness, irrevocability, uncertainty of the universality and content. The principle of reasonable non-discrimination can play an active role in promoting standard-setting, but practice also requires that it be given a more concrete and fulfilling meaning.
